29 CFR 1910.146(d)(3)(iii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including isolating the permit space: a) 1045 West Parsonage Rd, Seabrook, NJ - Third Floor, Cookline 3, batch kettles 2 and 3. The employer failed to implement isolating procedures for employees prior to entering the permit spaces of kettles 2 and 3, exposing the employees to struck-by and caught-in-between hazards. An employee suffered fatal injuries while conducting maintenance work in kettle 3 when the kettle was energized, on or about September 19, 2022. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.146(e)(1): Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit: a) 1045 West Parsonage Rd, Seabrook, NJ - Third Floor Cookline 3, batch kettle 3. An entry permit was not prepared where employee entered kettles 2 and 3 exposing them to struck-by and caught-in-between hazards. An employee suffered fatal injuries when conducting maintenance work in kettle 3 when the kettle energized, on or about September 19, 2022. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
