29 CFR  1926.451(e)(1):When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  a) Jobsite: 641 N 11th St., Philadelphia, PA 19123 - On or about August 25, 2022, the employer did not provide a safe means of access to and from each level of a scaffold by the use of portable ladders, hook-on ladders or other acceptable means. Employees climbed the scaffold end frames to access the 3rd working platform measuring approximately 20 feet above ground level.

Employees were exposed to hazardous chemicals such as, but not limited to, Crystalline Silica Quartz contained in the mortar used during masonry activities.

29 CFR  1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a)Jobsite: 641 N 11th St., Philadelphia, PA 19123 - On or about August 25, 2022, the employer did not ensure employees working from the 3rd platform of a supported tubular welded frame scaffold, approximately 20 feet above the ground level, were protected from fall hazards by the use of a fall protection system.  GTO Construction Inc was previously cited for a violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1511579, citation number 2, item number 2, and was affirmed as a final order on 7/28/2021, with respect to a workplace located at Messina Way and San Vancenzo Drive, Philadelphia, PA 19145.

29 CFR  1926.454(a):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   a)Jobsite: 641 N 11th St., Philadelphia, PA 19123 - The employer did not train employees working from the 3rd level of the supported tubular welded frame scaffold, exposed to an approximate 20 foot fall hazard, to recognize the hazards associated with working from scaffolds and to understand the procedures to control or minimize those hazards.  Condition noted on/about August 25, 2022.   GTO Construction Inc was previously cited for a violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1366683, citation number 1, item number 2b, and was affirmed as a final order on 10/4/2019, with respect to a workplace located at 3200 Napoli Way, Philadelphia, PA 19146.
