29 CFR 1926.501(b)(5): Each employee on the face of formwork or reinforcing steel was not protected from falling 6 feet (1.8 m) or more to lower levels by personal fall arrest systems, safety net systems, or positioning device systems: (a) On September 17, 2022, the employer did not ensure employees were protected from injury in that an employee working on the face of formwork was repositioning himself when he fell approximately 6.8 feet to the ground below. The employee sustained serious injuries after he struck hardened concrete on the ground. This condition exposed the employee to a fall hazard of approximately 6.8 feet.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used: (a) On or before September 17, 2022, the employer did not ensure that each employee engaged in working on the face of steel-formwork were trained in the use of a fall protection system used engaging in for that scope of work. An employee working on the face of steel-formwork was repositioning himself when he fell approximately 6.8 feet and sustained serious injuries after he struck hardened concrete on the ground. The fall protection system used did not ensure that the employee was tied-off at all times to prevent falling when repositioning. This condition exposed employees to fall hazards of 6.8 feet.
