OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to struck by hazards when working in the area of a Komatsu excavator. (a) 1099 Kings Mill Road, York PA, Torch Work Station - On or about September 21, 2022, employees were exposed to struck by hazards from the Komatsu excavator model #HB215LC-1 having a inoperable horn to alert employees nearby that the excavator was being used. (b) 1099 Kings Mill Road, York PA, Torch Station - On or about September 21, 2022, a spotter or signalman was not positioned to verify that employees walking or working near the Komatsu excavator model #HB215LC-1 were not in the path of the excavator prior to movement. (c) 1099 Kings Mill Road, York PA, Torch Station - On or about September 21, 2022, employees near the operational Komatsu excavator model #HB215LC-1 were exposed to struck by hazards from a lack of an audible travel alarm. (d) 1099 Kings Mill Road, York PA, Torch Station - On or about September 21, 2022, the Komatsu excavator model #HB215LC-1, was not provided with side-view mirrors exposing employees to struck by hazards. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
