29 CFR  1904.39(a)(2):  After the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, the employer did not report the in-patient hospitalization, amputation, or loss of an eye to OSHA within twenty-four (24) hours.  (a)	On or before September 9, 2022, the employer did not ensure that an in-patient hospitalization was reported to OSHA within twenty-four (24) hours  after an employee had suffered multiple injuries as the result of being  exposed to a fall hazard. The in-patient hospitalization was not reported until ten (10) days after the incident and this condition further exposed additional employees to fall hazards.

29 CFR  1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a)	On or before September 9, 2022, the employer did not ensure each employee on a walking /working surface with an unprotected edge 6 feet or more above the lower level were protected by an adequate protective system.  The guardrail system in place was not constructed properly to safely prevent employees from falling off the unprotected edge. This condition exposed employees to fall hazards of approximately 24 feet.

29 CFR  1926.502(b)(3): Guardrail systems shall be capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge.  (a)	On or before September 9, 2022, an employee tasked with retrieving an airline near the edge on the third level of a residential construction building was exposed to a fall hazard of approximately twenty-four (24) feet. The guardrail system was in place but not properly secure on both ends and unable to withstand, without failure, a force of at least 200 pounds as the employee used the top rail for support in order to reach for the airline.
