OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-between hazards. (a) On or about September 21, 2022, located in the Metal Fabrication Department, employees operated a Cincinnati Shear, model number 3DL12, serial number 39857 to cut metal material with the use of a makeshift alignment guide. The employer did not ensure employees were protected from the caught-between hazard of the work piece tipping up and subsequently snapping down from hydraulic hold down pressure when cutting with the shear. On September 21, 2022, an employee received a serious injury from the caught-between hazard created from the up and down movement of 3/8 inch steel workpieces while operating a Cincinnati Shear. No abatement certification or documentation is required for this item.
