29 CFR 1910.147(d):The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): (a) On September 26, 2022, employees were exposed to machine hazards associated with moving parts during servicing and troubleshooting the operation of the Landis Model "C" Landmaco Series threading Machine No. 20CL2C-43X located in the Stay Box Department. The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform servicing and troubleshooting work [per the 1910.147(d)(2) requirements]. As a result the remaining applicable energy control elements, involving machine shutdown[1910.147(d)(2)], machine isolation [1910.147(d)(3)], lock-out/tag-out device application [1910.147(d)(4)], dissipation or residual energy [1910.147(d)(5)(i), and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine servicing hazards. (b) On January 6, 2023, employees were exposed to machine hazards associated with moving parts during servicing and troubleshooting the operation of the Rousselle Model No. 4, S/N: 25775 forge, located in the Stud Department. The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result the remaining applicable energy control elements, involving machine shutdown[1910.147(d)(2)], machine isolation [1910.147(d)(3)], lock-out/tag-out device application [1910.147(d)(4)], dissipation or residual energy [1910.147(d)(5)(i), and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine servicing hazards. No abatement certification or documentation is required for this item.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) On or about September 26, 2022, one or more methods of machine guarding was not provided to protect employees who were exposed to caught-in hazards created by the rotating chuck of the Landis Model "C" Landmaco Series Threader, Machine No. 20CL2C-43X, located in the Stay Box Department. The employees reached over the rotating chuck to disengage the mechanical drive mechanism to stop the threading chuck of the machine or to stop the electrical drive of the machine. (b) On or about October 6, 2022, one or more methods of machine guarding was not provided to protect employees who were exposed to caught-in hazards created by the rotating chuck of the Landis Model "C" Landmaco Series Threader, Machine No. 20CL2D-22, located in the Stay Box Department. The employees reached over the rotating chuck to disengage the mechanical drive mechanism to stop the threading chuck of the machine or to stop the electrical drive of the machine. (c) On or about October 6, 2022, one or more methods of machine guarding was not provided to protect employees who were exposed to caught-in hazards created by the rotating chuck of the Landis Model "C" Landmaco Series Threader, Machine No. 20CL2B-36. The employees reached over the rotating chuck to disengage the mechanical drive mechanism to stop the threading chuck of the machine or to stop the electrical drive of the machine. (d) On January 6, 2023, one or more methods of machine guarding was not provided to protect employees who operated the Rousselle Model No. 4, S/N: 25775 forge and were exposed to caught-in hazards when loading or unloading parts being forged. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
