29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented. On or about September 23, 2022, and at times prior thereto, employees were installing decking onto a residential home under new construction without the use of a fall protection system, exposing the employees to a hazard of falling approximately twenty feet to the ground.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76cm) whichever is less were not equipped with one stair rail system along each unprotected side or edge. On or about September 23, 2022, the main stairway leading to the second story of a residential home under new construction was constructed without a stair rail when having four or more risers, exposing employees to fall hazards.
