On or about September 29, 2022 and at times prior to, employees caulked and patched exterior walls at a two story residential structure under construction, the employees were not protected from impact, falling objects or electrical shock by protective helmets.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. On or about September 29, 2022 at this work place, an employee caulked and patched exterior walls at a two story residential structure under construction, at a height of greater than 6 feet above a lower level, along an unprotected edge and did not have a fall protection system in place.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift. Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated On or about September 29, 2022 and at times prior to, an employee caulked and patched exterior walls at a two story residential structure under construction, the employee worked from an elevated platform without a personal fall arrest safety harness. The Vargas Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 1435703, citation number 1 , item number 2 and was affirmed as a final order on 1/30/2020 , with respect to a workplace located at 288 Hide Away Drive Port Aransas Texas 78373.
