Such programs would support the employer and employees in identifying and avoiding potential hazards such as cave-in and struck-by hazards during job site operations, decreasing the probability of employee injury or illness.

29 CFR 1926.300(b)(1):Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use: On or about October 3, 2022 the Evergreen Greenhouse Services LLC at jobsite located at 7554 State Route 109 Delta OH 43515, did not ensure a Metabo brand angle grinder was equipped with the appropriate factory installed guard while in use. Employees using the Metabo angle grinder in the unguarded condition during welding operations were exposed to potential struck-by, laceration and amputation injuries from the ungraded blade during cutting operations.

Several employees were exposed to cave-in hazards and injury which can occur from trench cave ins, and the inability to exit the trench quickly in case of an emergency

29 CFR 1926.651(k)(2):Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.: On or about October 3, 2022 the Evergreen Greenhouse Services LLC at jobsite located at 7554 State Route 109 Delta OH 43515, the employer failed to ensure that when a competent person performed a daily inspection of an excavation and found evidence of potential cave-in hazards existed, the employer failed to remove exposed employees from the hazardous area while performing heat pipeline installation activities in several four, five and six feet deep trenches.
