When the tool was withdrawn from the work, the lower guard did not automatically and instantly return to the covering position:  On October 4, 2022, employees performing framing operations were exposed to point of operations hazards due to the guards on the hand saws not automatically and instantly returning to the covering position.

Martin Sanchez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1559463, citation number 1, item number 1 and was affirmed as a final order on 12-06-21, with respect to a workplace located at 1617 136th ST, Lubbock, TX 79423.
