29 CFR  1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person.  a) On October 6, 2022, at the above addressed jobsite, an employee performing roofing work on a residential home, approximately seven feet above the lower level, was not using an anchorage point capable of supporting at least 5,000 pounds, thereby exposing the employee to fall hazards.    No abatement certification or documentation is required for this item.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On October 6, 2022, at the above addressed jobsite, employees were exposed to eye injury while operating pneumatic nail guns without eye protection while installing a new roof on a residential home.    No abatement certification or documentation is required for this item.  Don P Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 29CFR 1926.102(a)(1), which was contained in OSHA inspection number 1542933, citation number 1, item number 1, and was affirmed as a final order on August 31, 2021, with respect to a workplace located at 735 Michigan Avenue in Wilmette, Illinois.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) On October 6, 2022, at the above addressed jobsite employees performing roofing work were exposed to fall hazards of approximately 7 feet.  b) On October 6, 2022, at the above addressed jobsite employees performing roofing work were exposed to fall hazards of approximately 25 feet.  No abatement certification or documentation is required for this item.
