29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about 10/06/2022, an employee was exposed to a fall hazard while performing finishing activity on a new commercial construction site located at 1860 Elm Rd. NE Warren, Ohio 44483. The employee was working from an elevated height of 11'6" while standing on the midrail of the scissor lift. The protective means of the guardrail were bypassed and ineffective due to the employee's position.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedures to control or minimize those hazards. On or about 10/06/2022, an employee was working on an elevated scissor lift at commercial construction site located at 1860 Elm Rd. NE Warren, Ohio 44483. The employee had not been trained by a qualified person and was standing on the guardrail of a scissor lift while elevated from a height of 11'6", and as a result exposed a fall hazard.
