29 CFR 1926.302(b)(6): The use of hoses for hoisting or lowering tools was permitted. a- 48 Hamilton Court, Pennsauken NJ - On or about 10/06/22 the company owner lowered an air nailer, while standing on the top plate of a exterior wall frame, using the air hose it was connected to. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided: a- 48 Hamilton Court, Pennsauken NJ: The company owner was exposed to fall hazards, in excess of 9 feet 8 inches to the concrete floor surface below, when walking and working from a residential structure's exterior wall top plates without the use of fall protection. Condition observed on or about 10/06/22. b- 52 Hamilton Court, Pennsauken NJ: A worker was exposed to fall hazards, in excess of 8 feet 5 inches to the concrete floor surface below, when walking and working from a residential structure's exterior wall top plates without the use of fall protection. Condition observed on or about 10/06/22. Souza Brothers Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1539731, citation number 1, item number 2 and was affirmed as a final order on 09/30/21, with respect to a workplace located at 35, 37, 39, 41 Ortiz, Pennsauken NJ. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
