29 CFR  1910.132(d)(1)(i): Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;   (a)  On or about 9/27/2022, the employer did not provide and maintain a supply of personal protective equipment (PPE), such as but not limited to freezer gloves, dry ice gloves, freezer bibs and jackets, freezer socks and freezer boots, for employees on each shift who worked in the -10 degree F freezer to have clean, dry PPE without rips, tears, holes, and with zippers that worked.   (b)  On or about 10/3/2022 and 10/6/2022,  the employer did not provide and maintain a supply of personal protective equipment (PPE), such as but not limited to freezer gloves, for employees to get dry gloves without holes in the fingers throughout the shift as needed to protect the employees from frostbite while working in the -10 F freezer.

29 CFR  1910.132(d)(1)(iii): Select PPE that properly fits each affected employee.    (a)  The employer did not provide PPE in sizes to properly fit all employees who were exposed to the hazards of frostbite while working in the -10 degree F freezer, such as freezer gloves in medium and small sizes, dry ice gloves in medium and small sizes, freezer bibs and jackets in smaller and larger sizes, and freezer boots in widths and sizes to fit larger and smaller employees.

29 CFR  1910.132(f)(1)(v):   The employer shall provide training to each employee who is required by this section to use PPE.  Each such employee shall be trained to know at least the following:  The proper care, maintenance, useful life and disposal of the PPE.  (a)  Employees were not trained on how often to launder their freezer PPE, how to properly store freezer PPE, how to maintain the PPE so it remains useful, and when to dispose of torn, worn and damaged PPE, such as but not limited to freezer gloves, dry ice gloves, freezer bibs and jackets, freezer socks and freezer boots, used in the -10 degree F freezer to protect against frostbite.

29 CFR  1910.132(b): Employee-owned equipment. Where employees provide their own protective equipment, the employer shall be responsible to assure its adequacy, including proper maintenance, and sanitation of such equipment.   (a)  The employer did not ensure that employee owned personal protective equipment (PPE), such as but not limited to gloves, coveralls, jackets, and shoes, used by employees on each shift who worked in the -10 degree F freezer was adequate to provide protection from the cold temperatures and was maintained and sanitized.
