OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  a. On or before October 12, 2022, and at times prior, located in building four, a safety latch was not functional on the hook of the five-ton underhung crane. The employer did not ensure that the hook had a functional safety latch to secure chain slings in the hook. The condition exposed employees to crushing and struck by hazards.

29 CFR  1910.184(e)(1):Sling identification. Alloy steel chain slings shall have permanently affixed durable identification stating size, grade, rated capacity, and reach.  a. On or before October 12, 2022, the employer did not ensure steel chain slings had a durable identification that included size, grade, rated capacity, and reach.  In Bldg. 1 employees used a 10-ton crane with a three-legged steel chain sling with no identification.   b. On or before October 12, 2022, the employer did not ensure steel chain slings had a durable identification that included size, grade, rated capacity, and reach.  In Bldg. 2 employees used a 10-ton crane with a three-legged steel chain sling with an illegible identification tag.

29 CFR  1910.184(e)(9)(ii):Slings shall be removed from service if hooks are cracked, have been opened more than 15 percent of the normal throat opening measured at the narrowest point or twisted more than 10 degrees from the plane of the unbent hook.  a. On or before October 12, 2022, the employer did not ensure the hook openings of the steel chain sling were less than 15 percent of the normal throat opening.  In Bldg. 2 employees used a 10-ton crane with a three-legged steel chain sling, where the hook openings were stretched more that 15 percent, thereby exposing employees to struck-by or crushed-by hazards.

29 CFR  1910.252(b)(2)(iii):Protection from arc welding rays. Where the work permits, the welder should be enclosed in an individual booth painted with a finish of low reflectivity such as zinc oxide (an important factor for absorbing ultraviolet radiations) and lamp black, or shall be enclosed with noncombustible screens similarly painted. Booths and screens shall permit circulation of air at floor level. Workers or other persons adjacent to the welding areas shall be protected from the rays by noncombustible or flameproof screens or shields or shall be required to wear appropriate goggles.  a. On or before October 12, 2022, the employer did not ensure employees were protected from the rays from welding activities in the area. An employee was welding without the use of a screen or shield to protect other workers in the area.
