OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a) United States Welding DBA Rocky Mountain Air Solutions, 600 S. Santa Fe Drive, Denver, CO 80233: On or about 10/12/2022, the employer did not ensure that employees were protected from the hazards of a compressed gas cylinder tipping over and becoming a projectile on the dock area, outside the main entrance. The cylinders were vulnerable to being knocked over as they were not secured, or nested in such a manner as to maintain three contiguous points of contact. (b) United States Welding DBA Rocky Mountain Air Solutions, 600 S. Santa Fe Drive, Denver, CO 80233: On or about 10/12/2022, the employer did not ensure that employees were protected from the hazards of a compressed gas cylinder tipping over and becoming a projectile in the service department. The cylinders were vulnerable to being knocked over as they were not secured, or nested in such a manner as to maintain three contiguous points of contact. (c) United States Welding DBA Rocky Mountain Air Solutions, 600 S. Santa Fe Drive, Denver, CO 80233: On or about 10/12/2022, the employer did not ensure that employees were protected from the hazards of a compressed gas cylinder tipping over and becoming a projectile in the helium tank area. 29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6: (a) United States Welding DBA Rocky Mountain Air Solutions, 600 S. Santa Fe Drive, Denver, CO 80233: On or about 10/12/2022, the employer did not ensure that employees were protected from the hazards of a compressed gas cylinder tipping over and becoming a projectile on the dock area (outside front of the store). The acetylene cylinders were missing valve caps while the cylinders were vulnerable to being knocked over. (b) United States Welding DBA Rocky Mountain Air Solutions, 600 S. Santa Fe Drive, Denver, CO 80233: On or about 10/12/2022, the employer did not ensure that employees were protected from the hazards of a compressed gas cylinder tipping over and becoming a projectile in the service department area. 29 CFR 1910.303(b)(7)(iv): There were damaged parts that adversely affected safe operation or mechanical strength of the equipment, such as parts that were broken, bent, cut, or deteriorated by corrosion, chemical action, or overheating: (a) United States Welding DBA Rocky Mountain Air Solutions, 600 S. Santa Fe Drive, Denver, CO 80233: On or about 10/12/2022, the employer did not ensure that a 120 volt receptacle was properly installed outside on the west wall, along the walkway. The receptacle was not anchored to the concrete wall and was seen hanging by the wiring from the conduit. This exposed employee to shock and fire hazards.
