OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were elevated on the forks of forklifts exposing them to fall hazards. a) For the warehouse racking, on or about 10/14/2022, the employer exposed employees to fall hazards of approximately 20 feet, in that, employees rode on the forks of forklifts to access upper racking.

OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were operating forklifts without wearing seat belts. a) For the warehouse, on or about 10/14/2022, the employer exposed employees to crushing hazards in the event of a forklift tip-over or being ejected from the forklift, in that, the wearing of seat belts while operating forklifts was not enforced. Employees and managers were observed to not be wearing forklifts while operating them.

Rather propane cylinder restraints were defective and unlatched during operation.
