OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees due to struck by hazards: (a) Camden anchor on the Franklin Bridge track 2, Camden, NJ: The employer did not ensure that the track area where employees were to work was clear of train traffic prior to commencing work. Employees entered the track to perform their assigned work when they were struck by a train on or about 10/14/2022. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.200(g)(2): Traffic control signs or devices used for the protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices [incorporated by reference, see �1926.6], 2009 Edition, Section 6H-33, in that the employer did not ensure a shadow vehicle having a truck mounted attenuator was provided: a) Camden anchor on the Benjamin Franklin Bridge track 2, Camden, NJ: On the Benjamin Franklin Bridge Westbound lanes, employees were exposed to struck by hazards while operating in a lane closure without confirming that there was a shadow vehicle having a truck mounted attenuator behind the work vehicle on or about 10/14/22. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
