29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation:  a- 21 Cardinal Way, Mount Laurel NJ:  A worker was exposed to struck by hazards when using air nailers without eye or face protection.  Condition observed on or about 10/18/22.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:  a- 17, 21, 23 Cardinal Way, Mount Laurel NJ: Workers, not using fall protection, were exposed to fall hazards up to and in excess of 10 feet 5 inches, to the walking/working surface from the ground surface below, when performing framing, floor sheathing installation, other related activities while working/walking next to and near unprotected edges while on the second floor of residential structures. Condition observed on or about 10/18/22.  b- 17, 21 Cardinal Way, Mount Laurel NJ: Workers, not using fall protection, were exposed to fall hazards up to and in excess of 9 feet 6 inches, to the walking/working surface from the concrete flooring below, when performing framing, floor sheathing installation and other related activities while working/walking next to and at an unprotected stairway openings on the second floor of a residential structure. Condition observed on or about 10/18/22.  c - 17 Cardinal Way, Mount Laurel NJ: Workers, not using fall protection, were exposed to fall hazards up to and in excess of 8 feet 1 inch, to the walking/working surface from the concrete floor below, when accessing and egressing the top step of an A-framed ladder from/to the top plate of an inner wall frame.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   a- 17, 21, 23 Cardinal Way, Mount Laurel NJ: Workers, not using fall protection, were exposed to fall hazards up to and in excess of 8 feet  inches when performing floor sheathing installation, framing, and other related activities from a residential structure's second floor while working/walking next to and at unprotected edges as well as when working/walking next to and at an unprotected stairway openings. At the time of the worksite inspection, the company did not provide these worksite workers nor the company worksite Foreman with training to recognize and address the hazards associated with falls NOR how to properly use the worksite fall protection equipment.  Condition noted on or about 10/18/22.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:   a - 17 Cardinal Way, Mount Laurel NJ: As a result of there being a break in elevation in excess of 19 inches workers, not using fall protection, were exposed to fall hazards up to and in excess of 8 feet 1 inch when accessing and egressing the top step of an A-framed ladder from/to the top plate of an inner wall frame.  Observed on or about 10/18/22.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
