29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  a)  At 7047 Marble Court, Lot 40 Stonehaven, Gulf Shores, Alabama:  On October 18, 2022; the employer allowed his employees to operate pneumatic nail guns without eye protection while performing framing activities exposing his employees to struck-by hazards.

29 CFR  1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:  a)  At 7047 Marble Court, Lot 40 Stonehaven, Gulf Shores, Alabama:  On October 18, 2022; the employer allowed his employees to operate a skill saw on site with the guard wedged up exposing the blade and exposing his employees to struck-by hazards.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 7047 Marble Court, Lot 40 Stonehaven, Gulf Shores, Alabama:  On October 18, 2022; the employer allowed his employees to perform framing activities without fall protection exposing his employees to a fall hazard of 9 feet 5 inches to the ground below.  The Jayro Vivas Martinez dba Jayro Vivas Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13), which was contained in OSHA inspection number 1423495, citation number 1, item number 1and was affirmed as a final order on September 1, 2019, with respect to a workplace located at 3992 Stafford Boulevard, Lot 1 Aventura, Gulf Shores, Alabama and in OSHA inspection number 1501375, citation number 1, item number 1and was affirmed as a final order on February 4, 2021, with respect to a workplace located at 230 Hemlock Drive, Lot 87 Firethorne, Fairhope, Alabama.
