OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and crushing hazards.  Mechanic Shop- The employer did not ensure that the two automotive lifts in the Mechanic Shop were free from defects and in safe working order.  a) On or about October 20, 2022,  employees  were exposed to crushing hazards while working underneath elevated vehicle.  The employer did not ensure that the two post Forward Lift I10N00M, located in Bay 2, was lifting correctly.  Elevated vehicles were not level, as the lifting posts did not properly raise to an equal height.  b) On or about October 20, 2022,  employees were exposed to crushing hazards while working underneath  elevated vehicle.  The employer did not ensure that automated safety locks on the two post Challenger E10 Lift, located in Bay 3, were functional.  In the event of a hydraulic failure, there would be nothing to prevent the lift from dropping on an employee working beneath it.          Abatement documentation is required for this item in accordance with 29 CFR 1903.23(d)

29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) On or about October 20, 2022, Acorn Niles Corporation dba Acorn Tire & Service did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:  1) Requirement for labeling of containers of hazardous chemicals; 2) Material safety data sheet availability; 3) Training of employees; 4) A complete list of hazardous chemicals known to be in the workplace; 5) Methods to inform employees of the hazards on non-routine tasks; and 6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system; and any precautionary measures to protect employees.  Employees were exposed to hazardous chemicals, including petroleum distillates and brake cleaner.  Abatement documentation is required for this item in accordance with 29 CFR 1903.23(d)

29 CFR  1910.36(d)(1): Employees must be able to open an exit route door from the inside at all times without keys, tools, or special knowledge. A device such as a panic bar that locks only from the outside is permitted on exit discharge doors.   a) On or about October 20,  2022 an emergency exit located at the southwest corner of the Mechanic Shop was locked shut with a padlock.  Abatement documentation is required for this item in accordance with 29 CFR 1903.23(d)

29 CFR  1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.   a) On or about October 20, 2022,  an emergency exit located at the southwest corner of Mechanic Shop was obstructed with material and equipment.  Abatement documentation is required for this item in accordance with 29 CFR 1903.23(d)
