29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Lagunas Construction, LLC dba Jose Lagunas located at 2595 Serenity Lake Lane, Buildings #13 and # 14: On or about October 20, 2022, the employer did not develop and maintain effective safety and health programs such as but not limited to scaffolding and fall protection/prevention to ensure that hazards were identified and corrected onsite prior to employees conducting residential construction activities. The following condition exposed employees to electrical shock hazards and falls of over 15 feet.

29 CFR  1926.451(a)(6):Scaffolds were not designed by a qualified person.  a.  Lagunas Construction, LLC dba Jose Lagunas located at 2595 Serenity Lake Lane, Building # 13: On or about October 20, 2022,  the employer did not ensure that a platform being utilized to lift personnel using a MANITOU MTA Seris III 10055 telehandler rough terrain forklift was designed by a qualified person. One worker was exposed to a fall of over 15 feet when using a work platform (pallet) without guardrails or any other form of fall protection while performing framing activities as a part of a new home construction project.

29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.   a.  Lagunas Construction, LLC dba Jose Lagunas located at 2595 Serenity Lake Lane, Building # 13: On or about October 20, 2022, the employer permitted an employee to work off a work platform (pallet) that was elevated on the forks by a MANITOU MTA Series III 10055 telehandler rough terrain forklift, that was not approved by the manufacturer to lift personnel. By permitting the employee to work off the platform, the employer exposed his employee to a fall hazard of over 15 feet to the ground level.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a. Lagunas Construction, LLC dba Jose Lagunas located at 2595 Serenity Lake Lane, Building #13: On or about Oct 20, 2022, an employee was working from an elevated platform (pallet) being supported on the forks of MANITOU MTA Series III 10055 telehandler rough terrain forklift. The employee was not protected from a fall hazard of over 15 feet while working from the platform (pallet).

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a, Lagunas Construction, LLC dba Jose Lagunas located at 2595 Serenity Lake Lane, Building #14: On or about October 20, 2022, the controlling employer did not ensure sub-contractor employees were protected from falls while engaged in residential construction activities. Employees conducted framing activities without being provided a fall protection/prevention system, thereby exposing them to fall hazards of over 20 feet.
