29 CFR  1926.453(a)(2): Field modification of the aerial lift was not certified in writing by the manufacturer or by any other equivalent entity, such as a nationally recognized testing laboratory, to be in conformity with all applicable provisions of ANSI A92.2-1969:  (a) Driveway of Jobsite - The employer performed an unapproved field modification to the Nifty TM50 aerial lift by attaching a metal rack to the lift's basket/platform for use in hoisting materials, such as solar panels, from the ground to the roof, exposing employees to a lift tipping hazard, on or about October 24, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employees working from an aerial lift:  (a) Driveway - Employees used a Nifty TM50 aerial lift to access the main roof, two stories high at the driveway side of the residential home, to install a solar panel system on the rear side of the main roof.  While in the aerial lift, the employees did not wear harnesses and lanyards and attach to the boom or basket of the lift for fall protection, on or about October 20 and 24, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1926.454(a)(1): The employer failed to have each employee who performs work while on a scaffold trained regarding the nature of any electrical hazards, fall hazards, and falling object hazards in the work area:   (a) Driveway - Each employee who worked from the Nifty TM50 aerial lift did not receive training in appropriate fall protection methods to avoid fall hazards associated with the work, on or about October 20, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) Roof - Employees performed solar panel system installation on the rear side of the main roof of the residential home, three stories above grade.  The employees did not use any fall protection, exposing employees to the hazard of falling to a lower level, on or about October 20 and 24, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) Roof - Each employee did not receive training in appropriate fall protection methods to avoid hazards associated with elevated work areas, on or about October 20, 2022.  Belmont Solar, LLC was previously cited for a violation of this occupational safety and health standard CFR 1926.503(a)(1), which was contained in OSHA inspection number 1597984, citation number 1, item number 1d, and was affirmed as a final order on July 15, 2022, with respect to a workplace located at 2265 Porter Way, Lancaster, PA  17601.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
