OSH ACT of 1970 Section (S)(a)(l): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while operating a Trackmobile: On or about October 22, 2022, the employer had not provided sufficient operator training and an evaluation of the knowledge and understanding of those employees assigned to operate the Trackmobile, prior to permitting operation.

29 CFR 1910.272(j)(2)(ii): The employer did not immediately remove any fugitive grain dust accumulations whenever the exceeded 8-Jan inch (.32cm) at priority housekeeping areas, pursuant to the housekeeping program for grain elevators: On or about December 12, 2012, employees engaged in grain handling activities were exposed to fire and explosion hazards, and the employer did not immediately remove any fugitive grain dust accumulations whenever the amount exceeded 1/8 inch at priority housekeeping areas, pursuant to the housekeeping program for grain elevators. The following areas had dust accumulation ranging from 1.5 inches to greater than 6 inches: A. Head House, Elevator #1, B. Head House, Elevator #2, and C. Connection Tunnel between two Elevators.
