29 CFR 1910.147(c)(3)(i): The employer did not demonstrate that a tagout program would provide a level of safety equivalent to that obtained by using a lockout program when a tagout device was used on an energy isolating device which was capable of being locked out. a) For the yard pugmill, equipment number 701, on or about 10/14/2022 and at times prior to, the employer exposed employees to potential broken bones, amputation and laceration hazards, in that, tags were used instead of locks on energy isolation switches for the pugmill. Not all authorized maintenance employees were issued locks, and affected employees were not trained on what lockout tagout was.

29 CFR 1910.147(c)(4)(i):Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: a) For the yard pugmill, equipment number 701, on or about 10/14/2022 and at times prior to, the employer exposed employees to potential broken bones, amputation and laceration hazards, in that, specific energy control procedures were not documented and available for maintenance work on the pugmill. Pugmill equipment such as, but not limited to, belts, clutches, radiators, hydraulic lines and rotating shafts were worked on, containing hazardous energy in the form of high pressure hydraulics and rotating/moving parts from a diesel powered engine.
