1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) In the trench located at US 301 and County Road 52, Dade City, FL 33523: On or about 05/22/2023, the employer exposed employees to a cave in hazard, in that employees were conducting work in an excavation at a depth greater than 5 feet without using a protective system and the competent person did not remove the employees from the excavation.
