29 CFR 1910.95(g)(8)(ii)(B):Unless a physician determines that the standard threshold shift is not work-related or aggravated by occupational noise exposure, the employer did not ensure, when a standard threshold shift occurs, that for employees already using hearing protectors, employees be refitted and retrained in the use of hearing protectors and provided with hearing protectors offering greater attenuation if necessary: a.) Pennsylvania Grain Processing, LLC., production areas, on or about October 27th, 2022 and times prior thereto: Five employees with job titles including, but not limited to, Process Operator and Maintenance experienced standard threshold shifts in hearing. The employer did not conduct refitting and retraining on hearing protection with these employees. Additionally, the employer did not determine if the employees required hearing protection with greater attenuation. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
