29 CFR  1926.304(d):When the tool was withdrawn from the work, the lower guard did not automatically and instantly return to the covering position.  On or about October 27, 2022, employees operating Makita skill saws with lower guard wedged in the up position while cutting framing material exposing them to cuts and scrape hazards.  a)  Makita skill saw, inside the building, used to cut framing material with the lower guard wedged in the up position, b) Makita skill saw, outside the building, used to cut framing material with the lower guard wedged in the up position.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  On or about October 27, 2022, employees engaged in framing work without fall protection were exposed to unprotected fall hazards.  a) Employees worked at the height of approximately 22-feet were exposed to fall hazards, b) Employees worked at approximately 10-feet were exposed fall hazards.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  On or about October 27, 2022, on the construction site, the employer did not develop or provide fall protection training to the employees engaged in framing work to recognize and eliminate hazards such as falls.
