The referenced abatement certifications  were due on January 9, 2023 with respect to a work location at 40 Orchard St., Springfield, MA.

As of April 28, 2023, the employer had not provided abatement documentations for Citations 1-1,2-1,2-2a,2-2b, 2-3, contained in inspection 1631351, which was issued on December 12, 2022, and has a final order date of January 9, 2023 with respect to violations at 40 Orchard St. Springfield , MA.

Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19 (d) (1).

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system:  3276 Boston Rd., Wilbraham, MA: On or about October 10, 2022, an employee was observed working on a residential structure engaged in roofing activities with unprotected sides and edges greater than 9 feet above the next lower level and were not protected by either guard rails, safety net systems or personal fall arrest systems exposing them to fall from height hazards.  Edyn Perez DBA CH Construction Services was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.501(b)13 , which was contained in OSHA inspection number 1564445 citation number 1, item number 1  and was affirmed as a final order on 3/24/2022, with respect to a workplace located at 40 revere St., Springfield.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee who might be exposed to fall hazards:  3276 Boston Rd., Wilbraham, MA: On or about October 10, 2022, an employee was exposed to fall hazards as part of his assigned duties and the employer had not trained him prior to exposure to these hazards in topics such as but not limited to recognition of fall hazards, dangers of fall hazards and procedures each employee must take to prevent or minimize risk of such exposures.  Edyn Perez DBA CH Construction Services was previously cited for a violation of this occupational safety and health standard  29 CFR 1926.503 (a) 1 which was contained in OSHA inspection number 1564445, citation number 1 , item number  2 and was affirmed as a final order on 3/24/22, with respect to a workplace located at 4 Revere St., Springfield, MA.  Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d) (1).

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:  3276 Boston Rd., Wilbraham, MA: on or about October 10, 2022, an employee was observed using an aluminum extension ladder that did not extend any distance past the upper landing surface (roof) at this location, exposing the employee to fall hazards.
