29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about October 27 2022, at the jobsite located at 112 S. Concord Road, Oconomowoc WI, employees were performing roofing work on a two story residential building with pneumatic nail guns without safety glasses.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) On or about October 27 2022, at the jobsite located at 112 S. Concord Road, Oconomowoc WI, employees were performing roofing work on a two story residential building with a pitch of 12:12 with a fall height of approximately 16.1 feet without any fall protection in place, thereby exposing the employees to a fall hazard. The employees did not have fall protection training.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    (a) On or about October 27 2022, at the jobsite located at 112 S. Concord Road, Oconomowoc WI, three employees were exposed to fall hazards of approximately 16.1 feet without being protected from falling by the use of a fall protection system. The employees were performing re-roofing activities on the second story roof of a residential home.  (a) On or about October 27 2022, at the jobsite located at 112 S. Concord Road, Oconomowoc WI, two employees were exposed to fall hazards of approximately 9.9 feet without being protected from falling by the use of a fall protection system. The employees were performing re-roofing activities on the single story roof of a residential home.  Elias Bustillos was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1586271, citation number 1, item number 2 and was affirmed as a final order on April 22, 2022, with respect to a workplace located at 806 N Richmond St. Appleton Wisconsin.
