29 CFR  1926.502(d)(15):Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  a) Elias Bustillos dba MBE Roofing Specialist LLC does not require the use of fall protection during roofing operations. This violation was most recently observed on June 2, 2025, at a commercial re-roofing project located at 2580 West 9th Avenue in Oshkosh, Wisconsin. Employees were exposed to falls hazards of 10 feet 7 inches and greater while tearing off old roofing materials and were not utilizing a designed anchor point capable of supporting 5000lbs.  The anchor was not installed per manufacturer's recommendations as it was not installed into the roof with the required number of fasteners.  b) Elias Bustillos dba MBE Roofing Specialist LLC does not require the use of fall protection during roofing operations. This violation was most recently observed on June 2, 2025, at a commercial re-roofing project located at 2580 West 9th Avenue in Oshkosh, Wisconsin. Employees were exposed to falls hazards of 10 feet 7 inches and greater while tearing off old roofing materials and were not utilizing a designed anchor point capable of supporting 5000lbs.  There were multiple employees connected to an anchor that was only designed for one employee.

29 CFR  1926.501(b)(11):"Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  Elias Bustillos dba MBE Roofing Specialist LLC does not require the use of fall protection during roofing operations. This violation was most recently observed on June 2, 2025, at a commercial re-roofing project located at 2580 West 9th Avenue in Oshkosh, Wisconsin. Employees were exposed to falls hazards of 9 feet and greater while tearing off old roofing materials and installing new asphalt shingles without their harnesses being connected to lifelines or anchors.  MBE Roofing Specialist LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1751762, citation number 1, item number 3a and was affirmed as a final order on 12/02/2024, with respect to a workplace located at N85W15666 Menomonee River Parkway, Menomonee Falls WI 53051.   MBE Roofing Specialist LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1737738, citation number 1, item number 3 and was affirmed as a final order on 05/07/2024, with respect to a workplace located at 533 Broadmoore Drive, Hartford WI 53027.   MBE Roofing Specialist LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1705645, citation number 2, item number 1 and was affirmed as a final order on 12/22/2023, with respect to a workplace located at 440 North University Drive, Waukesha, WI.  Elias Bustillos dba MBE Roofing Specialist LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1631915, citation number 2, item number 1 and was affirmed as a final order on 04/18/2023, with respect to a workplace located at 112 S Concord Road, Oconomowoc, WI 53066.
