On or about November 3, 2022, and at times prior thereto, employees were framing a new apartment complex under construction using pneumatic nail guns without eye protection, exposing the employees to the hazard of being struck-by flying projectiles or debris.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented. On or about November 3, 2022, and at times prior thereto, employees were decking a new multifamily apartment complex under construction without the use of a fall protection system, exposing the employees to the hazard of falling approximately 35 feet to the ground below.
