29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids, or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about April 22, 2023, and at times prior thereto, employees were framing a new multifamily apartment complex under construction using a pneumatic nail gun without eye protection, exposing the employees to the hazard of being struck-by flying projectiles or debris. Cristian Rolando Alvarenga Jaco was previously cited for a violation of this occupational safety and health standard or it is equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number1632311, citation number 1, item number 1 and was affirmed as a final order on March 17, 2023, with respect to a workplace located at 7301 South IH 35, Austin, Texas.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest system, nor were an employee(s) provided with an alternative fall protection measure under another provision of 1926.502 (k) developed and implemented. On or about April 22, 2023, and at times prior thereto, employees were installing a moisture barrier on a new multifamily apartment complex under construction without the use of a fall protection system, exposing the employees to the hazard of falling approximately 35 feet to the ground below. The Cristian Rolando Alvarenga Jaco was previously cited for a violation of this occupational safety and health standard or it is equivalent standard 29 CFR 1926.501(b)(13, which was contained in OSHA inspection number 1632311, citation number 1, item number 2, and was affirmed as a final order on March 17, 2023, with respect to a workplace located at 7301 South IH 35, Austin, Texas.
