29 CFR  1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  a.) Unit B - On or about October 25, 2022, and days prior to, authorized employees performed service and/or maintenance on the Minster 6 OBI Press No. 2, Serial No. 6-16591.  The employer did not ensure that periodic inspections of the energy control procedures were performed at least annually as required by the standard.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  a.) Unit B - On or about October 25, 2022, and days prior to, employees were required to perform service and maintenance on machines, including but not limited to the Minster 6 OBI Press No. 2, Serial No. 6-16591 and Minster P2-100-48, Press No. 1.  The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)((i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.

Unit B - On or about October 25, 2022, the employer did not ensure an inspection program for the facility's mechanical power presses was established and followed.  An employee sustained an amputation while clearing a part from the die, when the clutch locked and caused the brake to fail on the Minster 6 OBI Press No. 2, Serial No. 6-16591.

29 CFR  1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):  a.) On or about October 25, 2022, and days prior to, employees performed service and/or maintenance on the Minster 6 OBI Press No. 2, Serial No. 6-16591 in Unit B.  The employer did not ensure the Lockout/Tagout procedure included specific steps for shutting down the equipment and the requirements for testing to verify the effectiveness of the energy control measures, thereby exposing employees to electrical and pneumatic hazards.
