29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   a) 5450 Carlisle Pike, Mechanicsburg, PA - On or about November 14, 2022, where respiratory protection was required to protect the health of employees tasked with asbestos management/abatement, the employer's written respiratory protection program was deficient in that it lacked the elements including, but not limited to:  1.) Procedures for selecting respirators for use in the workplace; 2.) Training of employees on any limitations of the respirator use; 3.) Procedures for regularly evaluating the effectiveness of the program.

29 CFR  1910.134(c)(3): The employer did not designate a program administrator who was qualified by appropriate training or experience to administer or oversee the respiratory protection program and to conduct the required evaluations of program effectiveness:  a) 5450 Carlisle Pike, Mechanicsburg, PA - On or about November 14, 2022, the respiratory protection (RP) program administrator lacked qualifications to maintain an effective respiratory protection program in that the program administrator did not:  1.)	Evaluate the effectiveness of the program to ensure that the respiratory protection program meet the requirements of 29 CFR 1910.134(c)(1)(i)-(ix). 2.)	Correct deficiencies in the respiratory protection program to meet the requirements of 29 CFR 1910.134(c)(1)(i)-(ix). 3.)	Understand their role in the selection process for respiratory protection based on respiratory hazards and assigned protection factors.

29 CFR 1904.32(b)(3):  A company executive did not certify that he or she has examined the OSHA 300 Log and that he or she reasonably believes, based on his or her knowledge of the process by which the information was recorded, that the annual summary is correct and complete:  IN THE ALTERNATIVE:  29 CFR 1960.67:  As required by 29 CFR 1904.32, the Agency did not certify that he or she has examined the OSHA 300 log and that the annual summary was correct and complete:   a) 5450 Carlisle Pike, Mechanicsburg, PA - On or about November 14, 2022, the federal agency did not ensure the agency's annual Form 300A injury/illness summaries were certified by its highest ranking  official for calendar year(s) 2019 and 2020.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
