29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59) a) Bayport worksite located at 1104 N Hancock St, Philadelphia, PA 19123. On or about November 3, 2022, The Employer did not ensure employees conducting brick washing activities with hazardous chemicals such as, but not limited to hydrogen chloride, etc. contained in Sure Klean were provided with effective information and training on hazardous chemicals. Bayport Construction Corp. was previously cited for a violation of this occupational safety and health standard 1910.1200(h)(1), which was contained in OSHA inspection number 1322371, citation number 1, item number 2-C and was affirmed as a final order on January 7, 2019, with respect to a workplace located at 555 Waverly Ave Brooklyn, NY 11238.

29 CFR 1926.50(g):Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: a) Bayport worksite located at 1104 N Hancock St, Philadelphia, PA 19123. On or about November 3, 2022, Employees conducting brick washing activities with corrosive materials contained in Sure Klean were not provided with affective eyewash facility with continues water supply within the work area for immediate emergency. Reference: American national Standard for Emergency Eyewash and Shower Equipment (ANSI Standard Z358.1-2004) Bayport Construction Corp. was previously cited for a violation of this occupational safety and health standard 1926.50(g), which was contained in OSHA inspection number 1322371, citation number 1, item number 3 and was affirmed as a final order on January 7, 2019, with respect to a workplace located at 555 Waverly Ave Brooklyn, NY 11238.
