29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   (a) Welding Area - On or about November 14, 2022 & November 22, 2022, employees were permitted to wear 3M 5000 Series Half Facepiece Disposable Respirators with Organic Vapor Cartridges while welding. The employer failed to ensure that those employees were medically fit to wear the respirators so that their use did not create additional health hazards.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(e)(1)(i): The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet.  (a) Welding Area - On or about November 14, 2022, the employer did not ensure that Lincoln Electric SuperArc L-56 and Unibraze Carbon & Low Alloy Steel Wire hazardous materials used in welding were included in the hazardous chemical inventory made available to affected employees thereby exposing them to illnesses associated with iron oxide fume inhalation, such as nose and lung irritation and exposure to illnesses associated with manganese inhalation, such as neurological damage and neurobehavioral disorder.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  (a) Manual Welding Cells - On or about November 22, 2022, the employer did not ensure that 1.9L Justrite plunger cans containing Sunnyside Acetone were labeled with the product identifier thereby exposing employees to fire and contact with skin, nose, and throat.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

The employer failed to provide information contained in 29 CFR 1910.134, Appendix D ("Information for Employees Using Respirators When Not Required Under the Standard"), thereby, exposing the employees to health hazards related to respirator misuse.
