Rafael Lopez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1612456, citation number 1, item number 1 and was affirmed as a final order on September 16, 2022, with respect to a workplace located at 14220 Gorman Falls, McAllen, TX 78502 .

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access. On or about November 17, 2022, at this worksite, employees engaged in framing activities, utilized an extension ladder to access/egress the roof that did not extend at least three feet above the roof landing.
