29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Vision Air HVAC Inc. DBA Vision Mechanical at 1050 35th LN Pueblo, CO 81006: On or before 11/21/22 the employer did not provide fall protection training to all employees who are or could be exposed to fall hazards. Employees installing ductwork on the roof of a commercial building were exposed to fall hazards associated with working in close proximity to an unguarded skylight cover, skylight roof openings, and roof perimeter fall hazards. This condition exposed employees to fall hazards greater than 13 feet. Abatement Note: Abatement certification and documentation are required for this item. See enclosed "Certification of Corrective Actions Worksheet."

29 CFR 1926.501(b)(4)(i):Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: (a) Vision Air HVAC Inc. DBA Vision Mechanical at 1050 35th LN Pueblo, CO 81006: On or before 11/21/22 Vision Air HVAC Inc. DBA Vision Mechanical failed to protect employees from injury in that employees did not use personal fall arrest systems or other acceptable means of fall protection or guarding for two skylights on the first level of roof at the Pueblo County High School. An employee fell through an unguarded skylight, constructed of a 1/8" translucent bubble made of Plexiglas or similar, and fell 13'2" onto the concrete floor beneath. Two employees then removed the bubbles and installed rigid, permanent covers over both skylight openings without using a fall protection system. These conditions exposed employees to fall hazards greater than 13 feet. Abatement Note: Abatement certification and documentation are required for this item. DBA Vision Mechanical failed to protect employees from injury in that the employer did not require the use of fall arrest systems or other acceptable means of fall protection while employees were hand-hoisting ductwork with a rope at the edge of the roof on the 1st and 2nd floors of a commercial building. This condition exposed employees to fall hazards greater than 10 feet. Abatement Note: Abatement certification and documentation are required for this item.
