29 CFR 1910.101(b): The employer failed to implement proper in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in Sec. 1910.6. On or about November 22, 2022, the employer failed to separately store pressurized tanks of acetylene, labelled as flammable, from pressurized tanks of oxygen, labelled as an oxidizer. Storing pressurized tanks of oxidizers and flammables together can cause a severe fire and explosion hazards to employees resulting in injury or death if the pressurized tanks ignite or explode from a open flame or heat source near the area where the tanks are stored.

29 CFR 1910.1200(f)(6)(ii): The employer failed to include product identifiers including words, pictures, symbols, or a combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. On or about November 22, 2022, the employer did not develop, implement, or maintain labels or product identifiers for hazardous chemicals stored in secondary bottles used in maintenance operations for the machinery used for production of concrete blocks. These secondary bottles contain products including but not limited to Grifcote FR-50-VOC and PB Penetrating Catalyst. Both products are labelled as health hazards and contain ingredients that are a health hazard including but not limited to distillates petroleum and naphthalene. The lack of secondary labeling can expose employees to serious health or physical hazards they might not be aware of with the chemical products.
