29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.   A) 870 New Dover Rd Edison, NJ 08820  Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on the front paved driveway were exposed to the hazard of crystalline silica inhalation due to lack of the employer's failure to implement engineering controls prescribed in Table-1 for control of dust. Employee(s) used a Stihl TS 420 portable saw without integrated water delivery system for continuously feeding water to the blade while cutting masonry blocks.   Conditions noted on or about 11/22/2022.

29 CFR  1926.1153(d)(2)(i):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  A) 870 New Dover Rd Edison, NJ 08820  Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on the front paved driveway were exposed to the hazard of crystalline silica inhalation due to lack of the employer's failure to implement engineering controls prescribed in Table-1 for control of dust. Employee(s) used a Stihl TS 420 portable saw without integrated water delivery system for continuously feeding water to the blade while cutting masonry blocks. Where the control measures prescribed in Table-1 were not implemented, the employer did not assess employees' exposure to crystalline silica through air monitoring. Employee(s) used a Stihl TS 420 portable saw without integrated water delivery system for continuously feeding water to the blade while cutting masonry blocks. An plan for controlling exposure to crystalline silica on jobsites was not developed & implemented by the employer.  Conditions noted on or about 11/22/2022.
