29 CFR 1926.651(g)(1)(i):Where oxygen deficiency (atmospheres containing less than 19.5 percent oxygen) or a hazardous atmosphere exists or could reasonably be expected to exist, the atmospheres in the excavation was not tested before employees entered excavations greater than 4 feet (1.22 m) in depth: a) Worksite was located at 9 Wilson Court, Manalapan, NJ 07726: Two workers engaged in plumbing work in a trench approximately six feet deep were subject to oxygen deficient atmospheres as the employer did not do air monitoring of the trench before the work commenced. Violation occurred on or about June 6, 2025 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.651(h)(1):Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. a) Worksite was located at 9 Wilson Court, Manalapan, NJ 07726: Two workers engaged in plumbing work in a trench approximately six feet deep were subject to struck by and caught in hazards while working. The trench had water seeping in through the sidewalls and standing water in the bottom of the trench that was contributing to the sidewalls sloughing off creating a potential for trench collapse. Violation was observed on or about June 6, 2025 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.651(j)(1):Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face: a) Worksite was located at 9 Wilson Court, Manalapan, NJ 07726: Two workers engaged in plumbing work in a trench approximately six feet deep were subject to struck by and caught in hazards as the trench did not have shoring to hold back the sidewalls in the event of a collapse. Soil samples taken on site identified the soil classification as Granular Type C. Violation occurred on or about June 6, 2025 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.651(k)(2):Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) Worksite was located at 9 Wilson Court, Manalapan, NJ 07726: Two workers engaged in plumbing work in a trench approximately six feet deep were subject to struck by and caught in hazards as the competent person on site did not recognize the distressed sidewalls of the trench. The sidewalls were sloughing off and undermining the ground on both sides of the trench. Violation occurred on or about June 6, 2025 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
