29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level. Jobsite - On or about November 22, 2022, the top edge of the guardrail at the top of the second floor stairs was at a height of 28 inches, where sub-contracted employees were using the stairs to access the loft area for work tasks and exposed to a fall of approximately 10 feet.

29 CFR 1926.1052(c)(3)(i): The height of stair rails installed after March 15, 1991, was less than 36 inches (91.5 cm) from the upper surface of the stair rail system to the surface of thread, in line with the face of the riser at the forward edge of the tread. Jobsite - On or about November 22, 2022, the top edge of the stair rail system leading to the second floor loft area was approximately 28 inches above the surface of the tread where it had been partially demolished. Sub-contracted employees were using the stairs to access the loft area for work tasks were exposed to a fall of between approximately 6-10 feet.
