Bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse.  a) On or about December 8, 2022 at the dock in the rear of the tractor trailer, employees unloading the trailer were exposed to sliding and collapsing boxes, bags, and other containers due to the packages being stored in tiers without being stacked, blocked, interlocked, or limited in height. Employees were exposed to struck by hazards while unloading the trailer.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a) On or about December 8, 2022, the employer did not ensure that each operator of the Global Industrial Semi-Electric Self-Propelled Pallet Jack Truck was competent through the completion of training and evaluation in that the operators were viewed having difficulties operating and maneuvering the pallet jack truck, moving loads that were too tall at approximately 8 feet tall, that were not stable to move in that the load created a tip over hazard.

29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.   a) On or about December 8, 2022, the employer did not provide a trainer to provide a combination of formal instructions and practical training.  Employees relied on reading the operator's manual to learn the controls, or an evaluation of the operator's performance prior to allowing employees to operate the Global Industrial Semi-Electric Self-Propelled Pallet Jack Truck.

Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace. (i) Truck-related topics: (A) Operating instructions, warnings, and precautions for the types of truck the operator will be authorized to operate; (E) Steering and maneuvering; (F) Visibility (including restrictions due to loading); (G) Fork and attachment adaptation, operation, and use limitations; (H) Vehicle capacity; (I) Vehicle stability; (J) Any vehicle inspection and maintenance that the operator will be required to perform; (K) Refueling and/or charging and recharging of batteries; (L) Operating limitations; (M) Any other operating instructions, warnings, or precautions listed in the operator's manual for the types of vehicle that the employee is being trained to operate. (ii) Workplace-related topics: (A) Surface conditions where the vehicle will be operated; (B) Composition of loads to be carried and load stability; (C) Load manipulation, stacking, and unstacking; (D) Pedestrian traffic in areas where the vehicle will be operated; (E) Narrow aisles and other restricted places where the vehicle will be operated; (G)Ramps and other sloped surfaces that could affect the vehicle's stability;    a) On or about December 8, 2022, the employer did not provide any of the required powered industrial truck content such as but not limited to truck related topics and workplace related topics for training beyond identification of the controls on the Global Industrial Semi-Electric Self-Propelled Pallet Jack Truck to the operators.

Caution shall be exercised when handling off-center loads which cannot be centered.  a) On or about December 8, 2022, the employer did not ensure that only stable or safely arranged loads were handled in that partially wrapped loads that were 8 feet tall with loose packages on top were moved using a Global Industrial Semi-Electric Self-Propelled Pallet Jack Truck, exposing employees to a tip over and struck by hazard.

29 CFR 1903.2(a)(1): Each employer shall post and keep posted a notice or notices, to be furnished by the Occupational Safety and Health Administration, U.S. Department of Labor, informing employees of the protections and obligations provided for in the Act, and that for assistance and information, including copies of the Act and of specific safety and health standards, employees should contact the employer or the nearest office of the Department of Labor. Such notice or notices shall be posted by the employer in each establishment in a conspicuous place or places where notices to employees are customarily posted. Each employer shall take steps to insure that such notices are not altered, defaced, or covered by other material.  a) On or about December 8, 2022, the employer did not post the Federal Safety and Health Poster. This was brought to the attention of the employer on November 16, 2022 and a link was provided to the employer.
