29 CFR  1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  Establishment - The employer did not ensure that employees who were working on the conveyor belt used to feed the steel palletizer machine at levels of 5 feet were equipped with fall protection system ((guardrails, netting, or arrest system). The employer was requiring employees get on the conveyer to free steel plates when they became stuck in the palletizer.

29 CFR  1910.147(c)(2)(ii):The employer's tagout energy control program procedures did not successfully comply with 29 CFR 1910.147(c)(3) and no lockout was provided for employee protection:  Establishment - Employer did not properly lock out machinery onsite to prevent accidental startup during maintenance:    a.  The block plant palletizer and conveyer belt feed system were being accessed to free stuck steel plates without isolating and locking power out to the hydraulic pumps that operate the conveyer and palletizer.   The system jammed twice the day of the inspection (11/30/22) as well as the day prior to the inspection (11/29/22).  b.  The MASA machine was not locked out during repair of the smoothing drum on 11/30/22.

29 CFR  1910.147(f)(1)(ii): Employees were not removed from the machine or equipment area in accordance with paragraph (e)(2) of this section during testing or positioning of machines, equipment or components thereof.  Establishment - The employer did not ensure that employees were removed from the machine or operation during the troubleshoot/test of the smoother roller on the MASA Machine.  Subsequently, the employee contacted a chain sprocket and severed the tip of his finger.
