OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to under-ride hazards:  (a) Warehouse - Sufficient safe clearance did not exist in floor level storage rack slots where employees operated Raymond 7000 series reach trucks.  These powered industrial trucks had an operator compartment height above the floor of 51 inches.  Some storage racks' first horizontal rack beams had a height above the floor of 60 inches, including, but not limited to, Aisle 40 slot location 42-01-01.  This would allow such horizontal rack beams to enter the operator compartment (an under-ride situation), pinning the powered industrial truck operator between the beam and the operator compartment or other truck component, on or about November 30, 2022.  Abatement certification and documentation required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking/working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  guardrail systems, safety net systems, or personal fall arrest systems:  (a) Repack Module - Employees went under the back stock shelves, located along the outer long sides of each Repack Module level, to retrieve boxes from pallets staged under back stock shelves.  The employees had no fall protection systems while under the back stock shelves, exposing employees to the hazard of falling 9 feet 11 inches from Repack Module Level 2 to grade, 19 feet 10 inches from Pick Module Level 3 to grade, and 29 feet 7 inches from Repack Module Level 4 to grade, on or about November 30, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1910.28(c): When an employee was exposed to falling objects, the employer did not ensure that each employee wore head protection that met the requirements of subpart I of this part. In addition, the employer did not protect employees from falling objects by implementing one or more of the following provided in 29 CFR  1910.28(c)(1) through 29 CFR  1910.28(c)(3) :  (a) Warehouse - On Level 2, Level 3, and Level 4 of the Repack Module, some areas under back stock shelves, located along the outer long sides of each level, had pallets containing loose boxes of products.  Employees walking and working in the grade-level aisles alongside and below the outer edges of Level 2, Level 3, and Level 4 of the Repack Module, did not wear hard hats.  In addition, the outer edges of Level 2, Level 3, and Level 4 of the Repack Module, the areas under back stock shelves, did not have any falling object protection, on or about November 30, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.29(b)(2): The employer did not ensure that guardrail systems met the requirement that  midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent intermediate members were installed between the walking-working surface and the top edge of the guardrail system when there was not a wall or parapet that was at least 21 inches (53 cm) high:  (a) Repack Module, West Long Side - The area between the shelves used for stray, not on file items and the southern-most yellow gate/window, on Level 2, Level 3, and Level 4 of the Repack Module, had only a horizontal steel member, 46.5 inches above the walking/working surface with no intermediate members and no wall or parapet, exposing employees to the hazard of falling 9 feet 11 inches from Repack Module Level 2 to grade, 19 feet 10 inches from Pick Module Level 3 to grade, and 29 feet 7 inches from Repack Module Level 4 to grade, on or about November 30, 2022.  No abatement certification or documentation required.

29 CFR  1910.132(c): Personal protective equipment was not of safe design and construction for the work to be performed:   (a) Warehouse - The employer provided employees, who operated Raymond 5000 series order pickers (referred to as MUOPs), with FallTech restraint lanyards, model number G8209WT, while elevated on order picker platforms.  FallTech, the manufacturer, designed this lanyard to prevent users from reaching a fall hazard; however, using this lanyard adjusted to a length of 6 feet exposed the employees to the hazard of falling from the order picker platform, on or about November 30, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  (a) Dollar General Distribution Center, 30 Martha Drive, Bethel, Pennsylvania - Employees performed servicing and maintenance activities on machinery and equipment, including, but not limited to, balers and Raymond and Crown powered industrial trucks. The employer did not develop and implement a compete energy control program, consisting of machine-specific energy control procedures, group lockout/tagout procedures, testing and positioning procedures, shift change procedures, and identification of authorized employees, and authorized employee training, exposing employees to hazards, including but not limited to, getting caught-in and struck-by moving machine/equipment parts and struck-by falling equipment, on or about January 11, 2023.  Abatement certification and documentation required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
