29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) New commercial construction located at 4147 Industrial Way, Oakwood GA 30502, the ground area below the elevated working platform: On or about December 1, 2022, and at times prior, the employer exposed an employee to struck-by hazards, in that the employer did not ensure that proper head protection was used during clean-up operations below the elevated working platform.

29 CFR  1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a)  New commercial construction located at 4147 Industrial Way, Oakwood GA 30502, work platform attachment: On or about December 1, 2022, and at times prior, the employer exposed employees to fall hazards of 19-feet to the lower ground level, in that the employer did not ensure that the guard rails around the manufactured work platform were 42-inches plus or minus 3 inches in height. The guard rails at the time of the inspection measured approximately 36-1/2 inches in height at the top rail.
