29 CFR  1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at least included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59)    a) Jobsite 519 Kaiser Blvd, Folcroft, PA - Exterior of Building: On or about November 14, 2022, a written Hazard Communication Program was not developed or implemented where employees were exposed to chemicals, including but not limited to the following:   -Titanium Dioxide, Propylene glycol, 2-(2-Methoxyethoxy)-ethanol, Hydrotreated heavy petroleum naptha, Calcium 2-Ethylhexanoate as contained in SHER-CRYL HPA High Performance Acrylic Gloss Coating. -etc.

29 CFR  1910.1200(g)(1):  Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use.   a) Jobsite 519 Kaiser Blvd, Folcroft, PA - Exterior of Building: On or about November 14, 2022, the employer did not have safety data sheets available for employees for each chemical used. Examples of these chemicals include, but not limited to:  -Titanium Dioxide, Propylene glycol, 2-(2-Methoxyethoxy)-ethanol, Hydrotreated heavy petroleum naptha, Calcium 2-Ethylhexanoate as contained in SHER-CRYL HPA High Performance Acrylic Gloss Coating. -etc.

29 CFR  1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  a) Jobsite 519 Kaiser Blvd, Folcroft, PA - Exterior of Building: On or about November 14, 2022, the employer did not ensure employees working from an aerial lift wore a body belt.  The employee was performing cap flashing while standing within the basket of an aerial lift raised approximately 47 feet from the ground without the use of a body belt with a lanyard attached to the boom or basket, thereby exposing employees to fall hazards.
