29 CFR  1910.28(b)(15): Walking-working surfaces not otherwise addressed.  Except as provided elsewhere in this section or by other subparts of 29 CFR part 1910, the employer must ensure each employee on a walking-working surface 4 feet (1.2 m) or more above a lower level is protected from falling by:  (i) Guardrail systems; (ii) Safety net systems; or (iii) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems.  a) On or before November 30, 2022, the employer did not ensure that each employee on a walking-working surface near an opening was protected from falling. Employees used a forklift and pallet jack to place pallets measuring approximately 3 feet 4 inches by 4 feet, through an unprotected opening in the wall towards the west end of the building on the second floor approximately 5 feet 9 inches wide, approximately 7 feet 9 inches high, and approximately 10 feet 3 inches from the lower level.  b) On or before November 30, 2022, the employer did not ensure that each employee on a walking-working surface near an opening was protected from falling. Employees used a forklift and pallet jack to place pallets measuring approximately 3 feet 4 inches by 4 feet, through an unprotected opening in the wall towards the east end of the building on the second floor approximately 6 feet 6 inches wide, approximately 8 feet 8 inches high, and approximately 10 feet 3 inches from the lower level.

29 CFR  1910.178(l)(1)(ii): Safe operation. Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).   a) On or before December 7, 2022, the employer did not ensure each operator successfully completed the training required by paragraph (l) prior to operating the Yale ERC060VGN36TQ096 serial number A968N11031M forklift in that the employee had not received knowledge training. The employee used the powered industrial truck to move pallets of boxed auto parts throughout the warehouse to include but not limited to materials on the second floor.  b) On or before December 7, 2022, the employer did not ensure each operator successfully completed the training required by paragraph (l) prior to operating the Crown PE4000-60 serial number 6A22665 Motorized Pallet Jack in that the employee had not received knowledge training. The employee used the powered industrial truck to move pallets of boxed auto parts throughout the warehouse.

Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a) On or before December 7, 2022, the employer did not provide training that consisted of a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace. The powered industrial vehicle operator received practical training, but did not receive formal instruction or an evaluation.

29 CFR  1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  a) On or before December 7, 2022, the employer did not ensure industrial trucks were examined before being placed in service.
